§9 Applicable law; jurisdiction
IX.1 The place of fulfillment for deliveries and payments shall be the company headquarters, currently at 2700 Wiener Neustadt, Herzog Leopold Strasse 5, Austria, even if delivery is to take place at a different location according to the agreement. Austrian law applies. The rules of UN law on the sale of goods shall not apply.
IX.2 All disputes directly or indirectly concerning the contractual relationship - independent of the amount in dispute - shall be subject to the exclusive jurisdiction of the ordinary court (Landesgericht Wiener Neustadt/Österreich) responsible for our company headquarters, currently at 2700 Wiener Neustadt, Herzog Leopold Strasse 5, Austria. Notwithstanding this provision the Seller may also select the respective court responsible for the counterparty.
IX.3 All disputes concerning the contractual relationship shall be governed exclusively by Austrian substantive law.
