§7 Warranty; damages; liability
VII.1 The warranty period is generally 12 months after transfer of risk.
VII.2 The Customer shall inspect the delivered merchandise immediately on receipt to determine its contractual condition and proper operation. Obvious defects and quantity discrepancies can only be claimed if they are noted immediately upon receipt of the merchandise and reported to SOREX within 3 business days. All other defects shall be reported in writing within 2 weeks of the merchandise delivery date, otherwise all claims for warranty and damages shall be lost. The warranty period shall neither be extended nor interrupted by the repair of defects or any attempts of repairs.
It shall rest with the contractual partner to submit evidence that the defect in question was present on delivery of the merchandise.
VII.3 Our warranty deed shall not cover defects resulting from wear and tear, incorrect or forcible operation, and non-compliance with the operation or maintenance manuals, overuse, or other tampering with the delivered product by the Customer or third-parties not belonging to our sphere of accountability. Further, it shall not cover defects as a result of modifications to the merchandise delivered by us, the exchange of parts, or the use of materials in combination with our product that do not comply with the original specifications.
In case of possible manufacturing or material defects of SOREX products or deviations from the respective standards, SOREX shall comply with its warranty obligations and either repair or replace the merchandise at the Customer’s choice.
