§3 Delivery; passing of risk
III.1 All specifications concerning the delivery time are non-binding.
III.2 If the requested goods are not available, the Customer will be notified of the unavailability within 5 working days.
III.3 In case of delivery delays the Customer shall grant us reasonable additional time of at least 14 days. If we remain belated with fulfilling the order, the Customer may cancel the order without the option to any additional claims.
III.4 If not specified otherwise, the goods are delivered by parcel service.
III.5 The risk of goods is transferred to the Customer on handover to the parcel service.
III.6 Partial deliveries shall be acceptable as long as they do not contradict the nature and purpose of the transaction or as long as no explicit agreement on the contrary had been made. Such partial deliveries may be invoiced separately.
III.7 Blanket orders have to be distributed and called from within 6 months if no contrary agreement has been made. After the period of acceptance has passed or if the Customer does not call from the stipulated order within 6 months of contract conclusion, we shall be entitled at our option – after an additional 2 week grace period –
to demand the acceptance and payment of goods or resign from the contract and claim full damages including lost profit due to non-compliance.
